Main Post Process & Timeline

The Trust integrates a number of environmental compliance statutes into its regulatory program. Chief among these are the National Environmental Policy Act (42 U.S.C. 4321 et seq.) and the National Historic Preservation Act (16 U.S.C. 470 et seq.).  The NEPA is our country’s basic national charter for environmental responsibility.  The NEPA process is designed to inform federal decision-makers (i.e., the Trust Board of Directors), and to involve the interested and affected federal, state, and local governments and the public in federal decisions affecting the quality of the human environment.  The National Historic Preservation Act (NHPA) of 1966 is the principal federal law dealing with historic preservation. Section 106 of the NHPA requires the Trust to take into account the effect of its undertakings on historic and archaeological properties, and afford “signatory and concurring parties” a reasonable opportunity to comment on Trust undertakings. The Section 106 process seeks to accommodate historic preservation concerns with the needs of the undertakings through agency consultation, commencing at the early stages of project planning. The goal of consultation is to identify historic properties potentially affected by the undertaking, assess its effects and seek ways to avoid, minimize, or mitigate any adverse effects on historic properties.
